TERMS AND CONDITIONS

1. Definitions

For the purposes of these terms and conditions, the following definitions apply:

Buyer – a natural person, legal entity, or deficient legal entity; Consumer – a natural person entering into a sales agreement with the Seller that is not directly related to their business or professional activity; Terms and Conditions – these terms and conditions, available at https://polishyourcooking.com/regulamin-sklepu Store – the online store operating at https://polishyourcooking.com Seller – Polish Your Cooking sp. z o.o., Złota 75A/7, 00-819, Warsaw, VAT ID: 7010977272


2. Preliminary Provisions

Through the Store, the Seller conducts retail sales while also providing electronic services to Buyers. Through the Store, the Buyer may purchase products listed on the Store’s pages.

The Terms and Conditions define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and Buyers.

Using the Store, including making a purchase, does not require the Buyer’s computer or device to meet any special technical requirements. The following are sufficient: internet access, a standard operating system, a standard web browser, an active email address.

The Buyer may not make a purchase in the Store anonymously or under a pseudonym.

It is prohibited to provide unlawful content while using the Store, in particular by submitting such content through forms available in the Store.

All product prices listed in the Store are gross prices (VAT inclusive).


3. Electronic Services

Through the Store, the Seller provides electronic services to the Buyer.

The primary electronic service provided by the Seller is enabling the Buyer to place an order in the Store. Orders can be placed without registering an account.

If the Buyer chooses to create an account, the Seller also provides the service of creating and maintaining that account. The account stores the Buyer’s data and order history. The Buyer logs in using their email address and a self-defined password.

An account is created by completing and submitting a registration form via the Store’s automated mechanism. Upon submission, an agreement for maintaining the account is concluded between the Buyer and the Seller for an indefinite period. The Buyer may terminate this agreement with immediate effect at any time by deleting the account.

Electronic services are provided to the Buyer free of charge. Sales agreements concluded through the Store are subject to payment.

To ensure the security of the Buyer and data transmission, the Seller implements technical and organizational measures appropriate to the level of risk, in particular measures preventing unauthorized access to or modification of personal data.

The Seller takes steps to ensure the Store functions correctly. The Buyer should notify the Seller of any irregularities or interruptions in the Store’s operation.

Any complaints regarding the Store’s operation may be submitted by email to pro@polishyourcooking.com. The Buyer should include their name, mailing address, and the type and date of the irregularity. The Seller will process complaints within 14 days of receipt and notify the Buyer of the outcome at the email address provided.


4. Placing an Order

The Buyer may place an order as a registered customer or as a guest.

A registered customer is a Buyer who has an account in the Store. An account can be created from the “MY ACCOUNT” tab or during the ordering process.

To place an order, the Buyer must: add a product to the cart by clicking “Add to cart”; click “Proceed to checkout” from the cart view; log in, create an account, or select “Buy as guest”; provide a shipping address and invoice details; select a delivery and payment method; read and accept the Terms and Conditions; click “Order with obligation to pay”.

If the Buyer selects payment via Przelewy24 or PayPal, they will be redirected to the relevant payment page. After payment, they will be redirected back to the Store’s order confirmation page. The sales agreement is considered concluded at that moment.

If the Buyer selects another payment method, they will be taken directly to the order confirmation page, at which point the sales agreement is considered concluded.

The Buyer must provide accurate personal data in the order form. The Buyer bears responsibility for providing false data. The Seller reserves the right to suspend order processing if the data appears false or raises reasonable doubts. In such cases, the Buyer will be notified by phone or email.

The Buyer declares that all data provided in the order form is accurate. The Seller is not obligated to verify its accuracy, though it has the right to do so as described above.

Products available in the Store: (a) entertainment events in the form of culinary workshops with a specified event date; (b) vouchers for culinary workshops, valid for 12 months from purchase; (c) workshop accessories including aprons, cutting boards, spice sets, recipes, etc.


5. Delivery and Payment Methods

The Buyer receives the purchased product electronically via email.

Available payment methods: Przelewy24 and PayPal.


6. Order Fulfillment

After placing an order, a confirmation will be sent to the Buyer’s email address.

An order is considered fulfilled upon sending the purchased product by email.

The validity period of each product is specified in its description.

Order fulfillment time is calculated from the moment payment is made.

After fulfillment, the Seller will send the Buyer a fulfillment confirmation and the purchased product by email.


7. Consumer Right of Withdrawal

A Consumer who has concluded a distance contract for services related to leisure or entertainment events with a specified date or period of service is not entitled to withdraw from the agreement.

The Seller may, at its discretion, agree to a withdrawal as an individual commercial gesture. To request this, please contact us at pro@polishyourcooking.com.

A voucher used to reserve a place at a culinary workshop is considered redeemed. The Consumer may not cancel the reservation and use the voucher at a different date. A voucher not used within its validity period is considered expired. Failure to use the voucher within its validity period does not constitute non-performance of service by the Seller and does not entitle the Buyer to a refund.


8. Vouchers

Vouchers purchased in the Store are valid for 12 months from the date of purchase, unless otherwise stated in the product description.

Upon expiry, the voucher becomes invalid and cannot be used.

Within 30 days of the voucher’s expiry date, the Buyer may submit a one-time reactivation request. Reactivation is subject to an administrative fee of PLN 30 gross and extends the voucher’s validity by a further 3 months. Reactivation requests should be sent to pro@polishyourcooking.com.

After the period specified in clause 3 has lapsed without a reactivation request, the voucher expires permanently and cannot be used. Vouchers cannot be exchanged for cash.

The Buyer is responsible for redeeming the voucher within its validity period. The Seller ensures workshop availability throughout the voucher’s validity period, though the schedule and topics may change.


9. Liability for Defects

The Seller is obligated to deliver products free from defects.

The Seller is liable to the Buyer if the sold product has a physical or legal defect (warranty for defects).

If the product is defective, the Buyer may: request replacement with a defect-free product; request removal of the defect; submit a statement of price reduction; submit a statement of withdrawal from the agreement.

If the Buyer identifies a defect, they should notify the Seller and specify their claim or submit an appropriate statement.

The Buyer may contact the Seller by traditional mail or email.

The Seller will respond to complaints within 14 days of receipt, using the same communication channel through which the complaint was submitted.

Details regarding the Seller’s warranty for defects are governed by the Civil Code (Articles 556–576).


10. Personal Data and Cookies

11. Out-of-Court Dispute Resolution

The Seller agrees to submit any disputes arising from product sales to mediation. Details will be agreed upon by the parties.

The Consumer may use out-of-court means of complaint resolution and redress, including: submitting a request to a permanent consumer arbitration court; submitting a request to a regional Trade Inspection authority to initiate mediation; seeking assistance from a district or municipal consumer ombudsman or a consumer protection organization.

The Consumer may also use the ODR platform at http://ec.europa.eu/consumers/odr for resolving disputes arising from online sales or service agreements.


12. Final Provisions

The Seller reserves the right to introduce and withdraw offers, promotions, and price changes without affecting rights already acquired by the Buyer, including terms of agreements concluded prior to any change.

The Seller reserves the right to amend the Terms and Conditions. Agreements concluded prior to any amendment are governed by the Terms and Conditions in effect at the time of conclusion.

Registered account holders will be notified of any changes to the Terms and Conditions by email. If the Buyer does not accept the new Terms and Conditions, they may terminate the account agreement at any time by deleting their account or submitting a written termination notice to the Seller.

These Terms and Conditions are in effect from 25 May 2018.


PRIVACY POLICY

Personal Data

The data controller within the meaning of personal data protection regulations is Polish Your Cooking sp. z o.o., Złota 75A/7, 00-819, Warsaw, VAT ID: 7010977272.

The purposes, legal bases, and retention periods for processing personal data are specified separately for each processing activity (see descriptions below).

Your rights. Under the GDPR, you have the following potential rights regarding your personal data: right of access; right to rectification; right to erasure; right to restriction of processing; right to object; right to data portability; right to lodge a complaint with a supervisory authority; right to withdraw consent, if consent was given.

These rights are not absolute and do not apply to all processing activities. We have made efforts to indicate which rights apply to each processing activity described below.

One right always applies: if you believe we have violated data protection regulations, you may lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).

Security. We guarantee the confidentiality of all personal data provided to us. We implement all security measures required by data protection law. Personal data is collected with due care and protected against unauthorized access.

Data processors. We entrust the processing of personal data to the following entities: Mailchimp – for the mailing system used to send newsletters; Dhosting Sp. z o.o. – for server storage; MRÓZ.CONSULTING – for IT support services; Przelewy24 – for payment processing; PayPal – for payment processing.

All processors guarantee appropriate security measures as required by law.


Processing Activities

User account. When creating an account, you must provide an email address and password. You may also optionally provide your name, billing address, and delivery address. Account data is processed solely to maintain the account and facilitate order placement. The legal basis is the performance of the account agreement under Article 6(1)(b) GDPR. Data is stored on servers provided by MRÓZ.CONSULTING. Data is retained for as long as the account exists; order data is retained after account deletion. You may access, modify, or delete your data at any time by logging in.

Orders. When placing an order, you must provide your name, billing and delivery address, email, and phone number. This data is processed for: order fulfillment (Article 6(1)(b) GDPR); invoicing (Article 6(1)(c) GDPR); accounting (Article 6(1)(c) GDPR); archival and statistical purposes (Article 6(1)(f) GDPR). Order data is retained until the limitation period for claims expires. Invoices must be retained for 5 years from the end of the tax year in which the tax obligation arose. You cannot rectify order data after fulfillment or request deletion until the limitation period expires.

Newsletter. Signing up for the newsletter requires your email address. The legal basis is your consent (Article 6(1)(a) GDPR). Data is processed via Mailchimp and retained until you unsubscribe. You may rectify or request deletion of your data at any time by unsubscribing.

Complaints and withdrawal. Data provided in a complaint or withdrawal statement (name, address, phone, email, bank account number) is processed to handle the complaint or withdrawal (Article 6(1)(c) GDPR). Data is retained for the duration of the procedure and may be archived for statistical purposes. You cannot rectify this data or request deletion until the limitation period for claims expires.

Email contact. When contacting us by email, you provide your email address and any other data included in your message. The legal basis is your consent arising from initiating contact (Article 6(1)(a) GDPR). After contact ends, the basis is our legitimate interest in archiving correspondence (Article 6(1)(c) GDPR). We cannot determine a specific retention period. You may request access to or deletion of correspondence, unless archiving is justified by our overriding interests, such as defense against potential claims.

Server Logs

Using the website involves sending requests to the server. Each request is recorded in server logs, including your IP address, date and time, browser type, and operating system. Log data is not associated with specific individuals and is used solely for server administration. Log contents are not disclosed to anyone other than authorized server administrators.
